We provide a bespoke, tailored service to our private clients via our system of block fees and also where applicable and subject to our own criteria we are prepared to act in certain cases that are funded via Legal Aid. We believe in transparent pricing and we offer block fees so you know how much it will cost to resolve your matter from the outset.
At Charles Ferguson Solicitors we are proud of our roots. Over the past four decades we have provided legal assistance and advise to those who qualify for legal aid. In light of the Legal Aid system in Scotland in the 21st century, we now act on a legal aid basis solely for clients who are in receipt of state benefits and are unemployed. This ensures our commitment to represent those who are particularly vulnerable in society.
If you are in employment we are prepared to act for you on a solely privately funded basis, we are happy to accept payment by instalments/all major credit/debit cards or bank transfer.
Please contact us for further details. We're fully accredited Legal Aid providers through the Law Society of Scotland. Subject to our criteria we can represent you with no upfront cost. Many serious criminal and road traffic cases attract Legal Aid cover. Unlike other law firms we will not charge you an hourly rate. If you were to be charged at an hourly rate the costs would be significantly higher.

How Legal Aid Works in Scotland
Criminal Legal Aid in Scotland is administered by the Scottish Legal Aid Board (SLAB). There are several types: Automatic Legal Aid (ABWOR) applies at first court appearances. Summary criminal Legal Aid covers cases in the Sheriff Court and JP Court. Solemn Legal Aid covers serious cases on indictment.

Do I have to be unemployed to get Legal Aid?
No. Legal Aid is means-tested on disposable income, not gross income. After deductions for tax, NI, housing, council tax, and dependants, many working people qualify.
Does Legal Aid cover road traffic offences?
Most road traffic cases are privately funded. However, serious charges like dangerous driving or causing death by dangerous driving may qualify for Legal Aid.
How long does a Legal Aid application take?
We submit applications promptly. SLAB typically processes applications within a few working days, though urgent cases can be expedited.
